Terms of Service

Welcome to Imperial V3

These Terms of Service ("Terms") govern your access to and use of Imperial V3's image hosting services, website, API, and related applications (collectively, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our Services.

1. Account Registration and Eligibility

1.1 Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you must have permission from a parent or legal guardian.

1.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password and API keys
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

1.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update this information as necessary.

2. Use of Services

2.1 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use our Services for your personal or commercial purposes.

2.2 Your Content

You retain all ownership rights to the images and content you upload ("Your Content"). By uploading content to our Services, you grant us a worldwide, non-exclusive license to:

  • Store, process, and deliver Your Content
  • Create backups and copies for redundancy and performance
  • Use metadata for analytics and service improvement

This license ends when you delete Your Content from our Services.

Where you use the URL upload feature to fetch and store content from an external source, you are solely responsible for ensuring you have the right to import, store, and share that content. We are not liable for content ingested via URL upload.

You may set individual uploads to automatically expire after a chosen period (1, 3, 7, 14, or 30 days). Expired uploads are moved to Trash and permanently deleted thereafter. We are not responsible for content lost due to a user-configured expiry.

2.3 Restrictions

You may not:

  • Reverse engineer, decompile, or attempt to extract source code from our Services
  • Use our Services to violate any laws or regulations
  • Interfere with or disrupt the integrity or performance of our Services
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Use our Services to transmit malware, viruses, or malicious code
  • Resell or redistribute our Services without written permission

3. Billing and Payments

3.1 Access Plans

Paid tiers of our Services are offered through time-based access keys. Pricing and features are described on our Pricing page. Keys are sold via SellAuth and grant access for a fixed period (e.g., 30 days) from the date of redemption.

3.2 Purchasing Access

When you purchase an access key:

  • Payment is a one-time charge processed by SellAuth — there are no recurring charges
  • Your access period begins when you redeem the key in your account settings
  • All fees are non-refundable except as required by law or stated in these Terms
  • You are responsible for all applicable taxes

3.3 Refunds

Because access keys are delivered digitally and grant immediate access upon redemption, all purchases are final and non-refundable unless required by applicable law. If you believe you were charged in error, contact us at [email protected].

3.4 Access Expiry

Access keys expire after their stated period. Upon expiry your account reverts to the Free tier. Your content is not deleted at expiry — only paid-tier features become unavailable. You may purchase a new key at any time to restore access.

4. Content Guidelines and Prohibited Use

You may not upload, store, or share content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or harmful code
  • Depicts or promotes illegal activities
  • Constitutes spam, phishing, or deceptive content
  • Violates our Acceptable Use Policy

We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts that repeatedly violate our policies.

5. Service Availability and Support

5.1 Uptime

We strive to maintain 99.99% uptime, but we do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

5.2 Support

Support levels vary by plan. Business plan users receive priority support with faster response times.

6. Intellectual Property

The Services, including all software, designs, graphics, and trademarks, are owned by Imperial V3 and protected by copyright, trademark, and other intellectual property laws.

"Imperial" and our logo are trademarks of Imperial V3. You may not use our trademarks without prior written permission.

7. Termination

7.1 Termination by You

You may terminate your account at any time through your account settings.

7.2 Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms or our other policies
  • Fail to pay fees when due (after the grace period)
  • Engage in fraudulent or illegal activity
  • Pose a security or legal risk to us or other users

7.3 Effect of Termination

Upon termination, your right to use the Services ceases immediately. Your Content will enter a 7-day grace period, after which it may be permanently deleted.

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 Limitation of Liability

To the maximum extent permitted by law, Imperial V3 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

8.3 Maximum Liability

Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Imperial V3, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services or violation of these Terms.

10. GDPR and Data Protection Rights

10.1 Your Rights Under GDPR

As a user in the European Economic Area (EEA), you have the following rights under the General Data Protection Regulation (GDPR):

  • Right to Access: Request a copy of your personal data
  • Right to Rectification: Correct inaccurate personal data
  • Right to Erasure: Request deletion of your personal data ("right to be forgotten")
  • Right to Restriction: Limit how we process your data
  • Right to Data Portability: Receive your data in a machine-readable format
  • Right to Object: Object to processing of your personal data
  • Right to Withdraw Consent: Withdraw consent at any time where processing is based on consent

10.3 Right to Lodge a Complaint

If you believe we have violated your data protection rights, you have the right to lodge a complaint with the Finnish Data Protection Ombudsman or your local data protection authority in the EU/EEA.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles. For users in the European Union, nothing in these Terms affects your statutory rights as a consumer under EU law.

11.2 Jurisdiction

The courts of Helsinki, Finland shall have exclusive jurisdiction over any disputes arising from these Terms. However, consumers in the EU may also bring proceedings in the courts of their country of residence.

11.3 Alternative Dispute Resolution

Before initiating legal proceedings, we encourage you to contact us directly to resolve disputes amicably. EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect.

Continued use of our Services after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must discontinue using our Services.

13. Miscellaneous

13.1 Entire Agreement

These Terms, along with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Imperial V3.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

13.4 Language

These Terms are provided in English. If we provide a translation, the English version will prevail in case of any conflict.
